Terms of
Service.

These terms govern your use of Mosey Studio and Mosey Pro. We've written them to be readable. By using the service you agree to these terms.

The short version

  • You own your photos and your generated mosaics. We don't claim any rights to them.
  • Saved mosaics are private by default. If you share one, you're responsible for having the right to share the source image. Free accounts can save up to 5 mosaics; Pro up to 50.
  • Don't upload content you don't have the right to use, and don't use the service for anything illegal.
  • Mosey Pro is a recurring subscription. You can cancel any time; you keep access until the end of the billing period.
  • If you're not happy within 14 days of your first payment, email us for a full refund — no questions asked.
  • These terms are governed by the laws of New Zealand.

01 / Who We Are

Mosey Studio ("we", "us", "our") is a trading name of Cameron Garvey, a sole trader based in New Zealand. Any questions about these terms can be sent to support@mosey.studio.

02 / Your Account

To create an account you must be at least 13 years old (or 16 where a higher age applies to digital services under local law). One account per person. You are responsible for keeping your login credentials secure and for all activity that occurs under your account.

We may suspend or terminate your account if you violate these terms, with or without prior notice depending on the severity of the breach.

03 / Your Content & Outputs

You own everything you upload and everything the app generates. We claim no rights to your photos or your mosaics.

You retain full ownership of any photos you upload ("your content") and any mosaic outputs the service generates. By using the service you grant us only the narrow licence required to operate it: rendering your image on your device in-browser, and (if you trigger an AI feature) transmitting a copy to our AI sub-processor as described in our Privacy Policy.

By uploading content, you represent and warrant that you own it or have sufficient rights to use it, and that doing so does not infringe the intellectual property rights or privacy rights of any third party. If you upload photos of other people, you are responsible for obtaining their consent.

Saved mosaics & sharing

When you save a mosaic, you grant us a limited, non-exclusive, royalty-free licence to store, reproduce, and serve your source photo, mask, thumbnail, and configuration solely for the purpose of providing the service to you (and, if you share the mosaic, to the recipients of your link).

By making a mosaic shared, you acknowledge that anyone with the link may view and remix it. You are solely responsible for ensuring you have the right to share the source image — including any third-party copyright, model releases, and applicable privacy laws. You can revert to private or delete your mosaic at any time from your library.

Storage limits: Free accounts may save up to 5 mosaics; Mosey Pro accounts may save up to 50. We reserve the right to adjust these limits with reasonable advance notice. We do not guarantee indefinite availability of stored mosaics, but we will provide reasonable notice before any service-wide deletion of user content.

We reserve the right to remove saved or shared mosaics that violate these terms (including the Acceptable Use section below) and to terminate accounts that repeatedly violate them.

04 / Acceptable Use

You may not use Mosey Studio to:

  • Upload or process child sexual abuse material (CSAM) or any content that sexually exploits minors.
  • Upload or process non-consensual intimate imagery (NCII) or deepfake pornography of any person.
  • Upload content that infringes third-party copyright, trademark, or other intellectual property rights.
  • Use the service for any unlawful purpose or in violation of any applicable law or regulation.
  • Reverse engineer, decompile, or attempt to extract the source code of the service, except to the extent permitted by applicable law.
  • Scrape, crawl, or systematically harvest data from the service in a way that creates unreasonable load, or systematically extract our curated emoji palettes, asset sets, or shader logic.
  • Circumvent, bypass, or attempt to evade any technical control, rate limit, access restriction, or security measure imposed by the service.
  • Resell, sub-license, or commercialise your Mosey credits or API access.

Violations of this section may result in immediate account suspension and, where required by law, reporting to relevant authorities.

05 / Subscriptions & Credits

Billing

Mosey Pro is billed monthly or annually depending on the plan you select at checkout. Prices are shown at /pricing. Payments are processed by Stripe. Applicable taxes (such as GST or VAT) are added at checkout where required by law.

Auto-renewal

Your subscription renews automatically at the end of each billing period until you cancel. You authorise us to charge the payment method on file for each renewal.

Cancellation

You can cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period — you retain Pro access until that date. We do not prorate partial periods unless required by law. Your subscription credits are a recurring monthly allowance that resets at the start of each month (on both monthly and annual plans); any unused subscription credits at cancellation are not carried forward. Purchased credits are not affected.

Price changes

If we increase the price of your current plan, we will notify you with reasonable advance notice before the change takes effect. Continuing to use the service after the new price takes effect constitutes acceptance.

Credits

AI features (background removal, depth maps, palette curation) consume credits. Credits are divided into subscription credits and purchased credits, which behave differently as described below.

  • Subscription credits — granted monthly (200 for Pro), including on annual plans which receive a fresh monthly allocation rather than one yearly lump. These credits do not carry over; unused credits expire at the end of each month and are replaced by a fresh allocation.
  • Purchased credits — received as a one-time welcome grant on sign-up (3 credits), or bought as one-off top-up packs. These credits do not expire while the service is available. Subscription credits are spent first; purchased credits are only drawn on once the subscription bucket is empty.

If an AI job fails on our end, credits are automatically refunded to the bucket they were deducted from. We do not issue refunds for credits consumed by completed (even imperfect) AI results.

Goodwill credits granted by our support team are added to the purchased bucket and do not expire.

Credits have no cash value, are not transferable, and cannot be redeemed for money. Credits represent a unit of access to services within Mosey and do not correspond to a fixed amount of compute or output.

We may change the credit cost required for specific features or operations from time to time to reflect changes in compute, infrastructure, or model costs. We may also modify, add, or remove features and services available for credit redemption.

If we discontinue the service, we will provide reasonable notice and may, at our discretion, offer refunds or extended access for unused purchased credits.

06 / Refunds & Cancellation

If you're not satisfied within 14 days of your first subscription purchase, email us at support@mosey.studio and we'll issue a full refund — no questions asked.

Refunds are processed via Stripe to the original payment method and typically appear within 5–10 business days depending on your bank. This 14-day voluntary refund right is in addition to any statutory rights you may have under the New Zealand Consumer Guarantees Act 1993 — those rights are not limited by this policy.

Renewal payments (after the first billing period) are generally non-refundable unless required by applicable law. We may consider reasonable requests — email us.

One-time credit pack purchases are non-refundable once any portion of the purchased credits has been used. Unused credit packs may be refunded within 14 days of purchase — contact us at support@mosey.studio.

07 / Intellectual Property

The Mosey Studio service, including its code, design, branding, mosaic rendering engine, curated emoji palettes, and all associated content we produce, is owned by Mosey Studio and protected by copyright and other intellectual property laws. These terms do not transfer any of our intellectual property to you. The name "Mosey Studio" and associated logos are our trademarks.

Your subscription grants you a personal, non-exclusive, non-transferable licence to use the service for its intended purpose while your subscription is active.

Mosey Studio incorporates third-party open-source fonts, assets, and libraries under their respective licences. Full attributions are listed on the credits page.

08 / IP Takedowns

We respect intellectual property rights. If you believe content on the service infringes your copyright, please send a notice to support@mosey.studio that includes:

  • Identification of the copyrighted work you claim has been infringed.
  • Identification of the infringing material and its location on the service.
  • Your contact information (name, address, email, phone).
  • A statement that you have a good-faith belief the use is not authorised by the copyright owner, its agent, or the law.
  • A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorised to act on the owner's behalf.

We will investigate and respond within a reasonable time. If you believe your content was removed in error, you may send a counter-notice to the same address.

09 / Disclaimers

The service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. AI-powered features (background removal, depth maps, palette curation) are probabilistic and may produce imperfect results.

We may modify, suspend, or discontinue any feature of the service at any time, including usage limits, storage limits, AI providers, or functionality. We are not liable for any such changes.

We may impose technical controls — including rate limits on requests to our API and edge functions — to protect availability and performance for all users. These controls are applied per account or IP address and may temporarily restrict access if thresholds are exceeded.

NZ consumer rights: Nothing in this section limits any rights you have as a "consumer" under the New Zealand Consumer Guarantees Act 1993 or the Fair Trading Act 1986. If you are acquiring the service for business purposes, you agree to contract out of the Consumer Guarantees Act to the maximum extent permitted by section 43 of that Act.

10 / Limitation of Liability

To the maximum extent permitted by applicable law, Mosey Studio's total liability to you for any claim arising out of or relating to these terms or your use of the service is limited to the fees you paid to us in the 12 months immediately preceding the claim.

In no event will we be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, or business interruption, even if we have been advised of the possibility of such damages.

NZ consumer rights: These limitations do not apply to the extent prohibited by the New Zealand Consumer Guarantees Act 1993 or the Fair Trading Act 1986.

Nothing in these terms excludes liability for fraud, wilful misconduct, or any liability that cannot be excluded under applicable law.

11 / Indemnification

You agree to defend, indemnify, and hold harmless Mosey Studio and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your content, your use of the service, or your violation of these terms.

12 / Termination

You may close your account at any time from your account settings or by contacting support@mosey.studio. We may suspend or terminate your account for violation of these terms. Upon termination, your right to use the service ceases immediately; active subscription access runs to the end of the paid period. Any unused purchased credits are forfeited on account closure and are not refundable.

Following account closure, we will delete your saved mosaics and account data within a reasonable period, except where retention is required for legal, accounting, fraud prevention, or security purposes.

Sections that survive termination include: Your Content & Outputs, Acceptable Use, Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law.

13 / Changes to These Terms

We may update these terms as the product evolves. The "Last updated" date at the top reflects the most recent revision. For material changes that negatively impact your rights or increase your obligations, we will notify signed-in users by email or a prominent in-app notice at least 30 days before the change takes effect. For minor clarifications, continued use of the service after the update constitutes acceptance of the revised terms.

14 / Governing Law & Disputes

These terms are governed by the laws of New Zealand, without regard to conflict-of-law provisions. Both parties agree to the exclusive jurisdiction of the courts of New Zealand for any dispute arising from these terms or your use of the service.

Before initiating any formal proceedings, please raise the dispute with us first by emailing support@mosey.studio. We'll aim to resolve it within 14 days.

15 / Entire Agreement

These terms and the Privacy Policy constitute the entire agreement between you and Mosey Studio regarding use of the service and supersede any prior understandings or agreements relating to it.

If any provision of these terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
